1.1 - It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

1.2 - This website may be used for your own private purposes and in accordance with these terms and conditions.

1.3 - You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Website Uptime

1.4 - All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

1.5 - Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

1.6 - Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy

(a) for which you have not obtained all necessary consents or copyrights;

(d) we reserve the right to refuse any order that we feel violates these above guidelines.

Exclusion of liability

1.14 - We do not accept liability for any loss or damage that you suffer as a result of using this website.

1.15 - Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United States.

Shipping

1.16 Your order will be processed and shipped without undue delay, typically within 3–7 business days for custom products and 1–3 business days for stocked items. In no event will processing exceed 14 days after order placement. Any delays beyond this window will be reported to you promptly with available detail.

1.17 Please allow up to 7 business days for carrier delivery following dispatch from our facility. Tracking information is provided by email once your order ships. We are not responsible for carrier-related delays once the package leaves our facility.

Cancellations, Returns, and Refunds

1.18 This section summarizes your cancellation and return rights. Full terms — including the return address, return shipping fee structure, restocking fees (none), and EU cooling-off rights — are set out in our Refund and Return Policy, which is incorporated into these terms by reference. Where this section and the Refund and Return Policy conflict, the Refund and Return Policy controls.

1.19 — Order cancellation (before shipment). All customers may cancel an order before it ships at no cost. Custom products — including personalized wall art, engraved tumblers, and any made-to-order item — may only be cancelled within 48 hours of order placement, because production begins shortly after that window closes. To cancel, email info@thebrightenergroup.com before the applicable deadline.

1.20 — Returns of non-custom items (after receipt). Non-custom items may be returned within 30 days of receipt under the terms of our Refund and Return Policy. To start a return, email info@thebrightenergroup.com. We will issue a prepaid return shipping label; for change-of-mind returns, the actual cost of the label will be deducted from your refund. For defective, damaged, or incorrect items, return shipping is at our expense.

1.21 — Custom Product Guarantee. Custom products are non-returnable for change of mind. However, every custom product is covered by our Custom Product Guarantee: if your custom item arrives defective, damaged, or incorrect, we will replace it, issue store credit, or issue a refund at our discretion. Contact support@thebrightenergroup.com with photos within 48 hours of receipt.

1.22 — Return address and method. Approved returns must be shipped — in the original packaging — to:

Items sent back without an approved return request will not be accepted. We reserve the right to refuse returns that do not meet the eligibility conditions in our Refund and Return Policy.

1.23 — Refund timing. Approved refunds — net of any return shipping label cost for change-of-mind returns — will be issued to the original payment method within 10 business days of our receipt and inspection of the returned item. Bank or card processors may add additional time before funds appear in your account.

1.24 — European Union 14-day cooling-off. If your order is shipped to a European Union address, you have the right to cancel or return your order within 14 days of receipt for any reason, without justification. Item eligibility and return-shipping cost terms in our Refund and Return Policy apply.

1.25 — Non-returnable items. Certain items cannot be returned, including custom and personalized products (except under the Custom Product Guarantee), perishable goods, personal care goods, hazardous materials, flammable liquids, gases, sale items, and gift cards. 1.26 — Recovery costs. If a return is initiated and the goods are not returned, or are returned at our expense without authorization, we reserve the right to deduct our direct cost of recovery (not exceeding the actual cost incurred) from any refund.
